(2) .—With respect to any contract entered into under paragraph (1) for the nuclear refueling and complex overhaul of a Nimitz class aircraft carrier, the Secretary may use incremental funding for a period not to exceed six years after advance procurement funds for such nuclear refueling and complex overhaul effort are first obligated.
(b) .—The prohibition in subsection (a) shall not apply to individual Joint Surveillance Target Attack Radar System aircraft that the Secretary of the Air Force determines, on a case-by-case basis, to be non-operational because of mishaps, other damage, or being uneconomical to repair.
(b) .—The report on munitions strategy required by subsection (a) shall include the following: (1) An identification of current and projected munitions requirements, by class or type.
(7) Transportation capacity and responsiveness, particularly with respect to the transportation of fuel, water, and cargo. (9) Tactical mobility and tactical wheeled vehicle capacity, including heavy equipment prime movers. (d) .—The Secretary of the Air Force shall ensure the Air Force maintains a minimum of 171 A–10 aircraft designated as primary mission aircraft inventory until a period of 90 days has elapsed following the date on which the Secretary submits to the congressional defense committees the report under subsection (e)(2).
(b) .—Not later than April 1, 2017, the Secretary of Defense shall submit to the congressional defense committees a report containing— (1) the assessment conducted under subsection (a); (2) recommendations for reducing or eliminating shortfalls in responsiveness and capacity with respect to each of the capabilities described in such subsection; and (3) an estimate of the costs of implementing such recommendations. (e) .— (1) The Director of Operational Test and Evaluation shall submit to the congressional defense committees a report that includes— (A) the results and findings of the initial operational test and evaluation of the F–35 aircraft program; and (B) a comparison test and evaluation that examines the capabilities of the F–35A and A–10C aircraft in conducting close air support, combat search and rescue, and forward air controller airborne missions.
.—The Secretary of the Navy may procure materiel and equipment in support of the construction of the Ford class aircraft carriers designated CVN–80 and CVN–81 in economic order quantities when cost savings are achievable. (2) Subsections (a) through (e) shall apply with respect to any A–10 aircraft affected by the transition described in paragraph (1).
(2) .—Any contract entered into under paragraph (1) shall provide that any obligation of the United States to make a payment under the contract is subject to the availability of appropriations for that purpose, and that total liability to the Government for termination of any contract entered into shall be limited to the total amount of funding obligated at time of termination. .—Except as provided by subsection (b) and in addition to the prohibition under section 144 of the National Defense Authorization Act for Fiscal Year 2016 (Public Law 114–92; 129 Stat.
